Tribunal Update - Round 17

AFLNT wishes to advise the independent Tribunal sat on Wednesday 14 February to hear four charges from Round 17 of the TIO NTFL competition.

TIO NTFL Women’s Premier League – Round 17

Desiree Gordon, of Palmerston Magpies Football Club appeared before the Tribunal to answer the charge of kicking during the the fourth quarter of the TIO NTFL Women’s Premier League match between Nightcliff Football Club and Palmerston at TIO Stadium on Sunday 11 February 2018.

Gordon pleaded not guilty and in summary, was found not guilty of kicking. 

TIO NTFL Men’s Division One

Alan Graham, of Darwin Buffaloes Football Club, appeared before the Tribunal to answer the charge of charging during the fourth quarter of the TIO NTFL Men’s Division 1 match between Darwin Buffaloes and Banks Football Club at TIO Stadium on Saturday 10 February 2018.

Graham pleaded guilty and in summary, was found guilty of charging. 

Based on the evidence available, the Tribunal upheld the incident as intentional conduct, high impact and high contact, resulting in a two-match suspension. 

Adrian McAdam, coach of Southern Districts Football Club, appeared before the Tribunal to answer the charge of using abusive language towards or in relation to an umpire during the first quarter of the TIO NTFL Men’s Division 1 match between Waratah Football Club and Southern Districts at Gardens Oval on Sunday 11 February 2018. 

McAdam pleaded not guilty and in summary, was found not guilty of using abusive, insulting, or obscene language towards or in relation to an umpire. 
 

Matthew Arundell, of Waratah Football Club, appeared before the Tribunal to contest the charge of striking during the fourth quarter TIO NTFL Men’s Division 1 match between Waratah Football Club and Southern Districts Football Club at Gardens Oval on Sunday 11 February 2018. 

Arundell pleaded not guilty and in summary was found not guilty of striking. 

Appeals Process

All clubs, and guilty parties have until 5pm Thursday 15 February to lodge an appeal with AFLNT.  The grounds for appeal under the 2017 State and Territory Tribunal Guidelines are as follows:

4.3 Grounds for Appeal
  
Except where otherwise determined by the Controlling Body, a Person, Club and/or the Controlling Body, may appeal to the Appeal Board in respect of a decision made by the Tribunal under these Guidelines on one or more of the following grounds:
 
a) that there was an error of law;

b) that the decision was so unreasonable that no Tribunal acting reasonably could have come to that decision having regard to the evidence before it;

c) the classification of the level of the offence was manifestly excessive or inadequate; or

d) that the sanction imposed was manifestly excessive or inadequate.
